Prescott Cleared of Civil Claims Amid Ongoing Legal Battles
Months after the Dallas Police Department decided not to move forward with any charges, a Collin County judge has now cleared Dak Prescott of all civil claims related to sexual assault allegations made against him. These allegations, which date back to 2017, have cast a long shadow over Prescott but are now being systematically dismantled in court.
The accusations initially came with a hefty price tag; the accuser sought $100 million in exchange for not taking the matter to the police. Despite this attempt at resolution, the accuser filed a report with the Dallas Police Department in March. In an assertive response, Prescott filed both a civil lawsuit and a criminal report against the accuser.
In April, the saga took another turn when the accuser’s attorney dropped a Dallas County lawsuit, only to file a similar claim in Collin County. However, by June, Judge Angela Tucker dismissed these new claims. The Dallas Police Department also concluded there was insufficient evidence to support the allegations against Prescott.
Levi G. McCathern, Prescott’s attorney, commented, "As we knew they would, they found nothing in their extensive exploration of the facts that would support a criminal prosecution." He went on to condemn the persistent allegations, stating, "The original lies by [the accuser], her team, and their recent failed attempt to sue him civilly are all just a continuation of their extortion plot against Dak."
In a bold move, Prescott filed a civil lawsuit seeking over $1 million, accusing the parties involved of extortion. The accuser’s attorney had previously sent a letter in January suggesting she would drop the pursuit of criminal charges in return for $100 million. This letter further buttressed Prescott’s claims of extortion.
While one part of this complex legal puzzle is resolved, the battle is far from over. Prescott's lawsuit and the accuser's counterclaims alleging extortion are still brewing in the civil court of Collin County. A hearing scheduled for September aims to determine if further legal action against the accuser is necessary.
The accuser's legal maneuvers continue as her motion for a "non-suit without prejudice" leaves the door open for potential refiling of the case in Dallas County. This procedural step is a critical move that keeps open the possibility of new charges despite her claims being dismissed in Collin County.
Prescott, who is entering the final season of a lucrative four-year, $160 million contract in 2024, spoke with confidence regarding his legal battles. "I know the truth, I'm confident in what we filed, very confident in what we filed," Prescott asserted. Despite the distractions, he remains focused on his career and personal life. Prescott is a new father to a baby girl, a fact his attorney highlighted to underscore his empathy for genuine survivors of sexual assault.
Levi G. McCathern emphasized the broader societal impact of such allegations, stating, "These ploys distract from the trauma of legitimate sexual assault survivors and undermine the progress that our society has made in supporting them." The legal team remains steadfast, with McCathern adding, "We are confident that at the end of law enforcement's investigation into the extortion case that they will find the accuser and her attorneys just as guilty as Dak is innocent."
Throughout this ordeal, Prescott has consistently maintained his innocence. McCathern reiterated, "To be clear, Mr. Prescott has never engaged in any nonconsensual, sexual conduct with anyone. Lies hurt. Especially, malicious lies. We will not allow the Defendant and her legal team to profit from this attempt to extort millions from Mr. Prescott."
