Former Phoenix Suns DE&I Program Manager Files Complaint and Seeks $60 Million in Damages

Andrea Trischan, the former program manager for diversity, equity, and inclusion (DE&I) for the Phoenix Suns, has filed a high-profile complaint with the U.S. Equal Employment Opportunity Commission and the Arizona attorney general’s office's civil rights division. Trischan, who served in her role from September 2022 to July 2023, is alleging wrongful termination and seeking $60 million in damages.

Allegations and Response

In her complaint, Trischan alleges that she was subjected to a hostile work environment and overt racist comments during her tenure with the Suns. She claims that her concerns, which included the appointment of several executives accused of misconduct to a newly established diversity council, went unaddressed despite being reported to the team’s human resources department and executive leadership. Her attorney, Sheree Wright, has echoed these claims, stating that Trischan experienced a "hostile work environment that went unaddressed despite being reported to HR and executive leadership."

Trischan's journey took a pivotal turn in late May 2023, when she was placed on a performance improvement plan. According to her, this action was a precursor to her termination in July 2023.

In a forceful rebuttal, the Phoenix Suns have categorically denied any wrongdoing. Stacey Mitch, the senior vice president of communications for the Suns and Mercury, stated, "A former employee who last worked for the organization in 2023 was terminated after less than 10 months due to repeated failure to perform her job duties."

A Clash Over DE&I Initiatives

A significant point of contention revolves around the Suns’ newly established diversity council. Trischan expressed concerns over the inclusion of executives accused of past misconduct. However, a spokesperson for the Suns disputed these claims, remarking, "Ms. Trischan's claims regarding the diversity council are misleading. The purpose of the diversity council, which is comprised of the entire executive team and other leaders in the organization, is to listen to the diversity data and information on DE&I initiatives to continue to further the organization's DE&I commitment."

Mitch further added that Trischan's claim was an opportunistic maneuver: "This individual filed a baseless charge with a state agency and is now trying to use ESPN reporting from 2022, specific to previous ownership, to make egregious claims in order to support her ridiculous demand for $60 million from the Suns organization."

Background and Context

The backdrop of this dispute includes earlier controversy involving the Phoenix Suns’ former owner, Robert Sarver, who was suspended by the NBA following findings of inappropriate workplace conduct. This scandal saw Jason Rowley, the former team president and CEO, resign in February 2023. Around the same time, Mat Ishbia's purchase of the team was finalized, marking a new chapter for the organization.

Despite the turmoil under previous ownership, the current Suns leadership has maintained their commitment to improving workplace culture. "The Suns continue to participate in the [Arizona Civil Rights Division] review in good faith. We are confident that after the ACRD completes its review of Ms. Trischan's charge, the ACRD will confirm that Ms. Trischan's claims are factually and legally baseless," a Suns spokesperson affirmed. The organization has pledged full cooperation with the ongoing review by the Arizona Civil Rights Division (ACRD).

Mitch echoed this sentiment, emphasizing the organization’s confidence in its legal standing: "To be clear, this individual is making false claims in an attempt to gain tens of millions of dollars. We are confident the courts will find no merit to these claims and quickly resolve this matter. The Phoenix Suns and Phoenix Mercury are creating a world-class organization for every employee. We will not let opportunists succeed in their attempts to manipulate the media and use years old reporting to seek financial gain."

Looking Ahead

As the situation develops, the sports community watches closely. This case not only brings attention to the specific grievances of Andrea Trischan but also highlights ongoing challenges within professional sports organizations to foster an inclusive and respectful work environment. How the Phoenix Suns navigate this legal and reputational challenge remains to be seen, but the case is set to serve as a significant benchmark for DE&I issues in the sports industry.
